Former Prosecutors Examine Federal Drug Cases From the Government’s Perspective

A drug allegation can become a federal case when it involves a DEA or FBI investigation, interstate activity, federal property, or systems such as the mail. That shift brings different prosecutors, investigative resources, sentencing rules, and court procedures. Federal prosecutions arising from Kendall County are generally heard in the U.S. District Court for the Northern District of Illinois.

Our firm is led by former prosecutors Andrew and Hope Nickel, who bring more than 25 years of combined legal experience. Andrew served in the Kendall County State’s Attorney’s Office and as an Assistant State’s Attorney in Kane County. Hope served for roughly five years as an Assistant State’s Attorney, first in Kendall County and then in LaSalle County. This background allows us to examine how the government developed its evidence and may present its case.

Charges Prosecuted Under Federal Drug Laws

The Controlled Substances Act regulates the manufacture, possession, and distribution of controlled drugs. Under 21 U.S.C. 841, federal prosecutors commonly pursue charges involving distribution, possession with intent to distribute, and manufacturing.

Federal charges may involve:

  • Drug trafficking or distribution: Allegations that a person transferred, sold, or intended to distribute a controlled substance.
  • Possession with intent to distribute: Claims that the quantity, packaging, communications, money, or other evidence indicates an intent to distribute drugs.
  • Drug manufacturing: Allegations involving a laboratory, grow operation, production equipment, or materials used to make a controlled substance.
  • Drug conspiracy: Claims that two or more people agreed to violate federal drug law. One conspiracy charge can name numerous defendants with substantially different alleged roles.

A federal grand jury indictment is a formal accusation approved by grand jurors after reviewing evidence presented by prosecutors. It isn’t a finding of guilt. Once an indictment is returned, the case can proceed through arraignment, discovery, pretrial motions, plea negotiations, and trial.

How Drug Quantity Affects Federal Sentencing

Under 21 U.S.C. 841, the type and alleged quantity of a controlled substance can determine the statutory sentencing range. Qualifying quantities commonly trigger five-year or 10-year mandatory minimum sentences. Prior convictions and allegations involving death or serious bodily injury can increase the potential penalties, depending on the statute and facts.

Federal sentencing also differs from Illinois sentencing because the federal system generally doesn’t use traditional parole. Courts consider the applicable statute, advisory federal sentencing guidelines, criminal history, alleged conduct, and other factors when determining a sentence.

Safety valve relief can allow certain defendants to receive a sentence below an otherwise applicable mandatory minimum. Eligibility under 18 U.S.C. 3553(f) depends on specific requirements involving criminal history, violence, leadership role, resulting injury, and disclosure of information to the government. We evaluate each requirement rather than assuming a mandatory minimum controls the outcome.

Building a Defense Around the Government’s Evidence

Investigations may involve surveillance, confidential informants, controlled purchases, recorded communications, search warrants, and testimony from cooperating witnesses. Building a defense requires close review of how each piece of evidence was obtained and whether it proves the charged conduct beyond a reasonable doubt.

Depending on the evidence, our review may address:

  • Searches and seizures: Whether agents had a valid warrant, remained within its scope, or relied on a lawful exception to the warrant requirement.
  • Possession and knowledge: Whether the government can prove actual or constructive possession, including knowledge of the substance and the ability to control it.
  • Informant reliability: Whether a confidential source had incentives, inconsistencies, credibility issues, or limited firsthand knowledge.
  • Drug quantity: Whether testing, records, witness testimony, or other reliable evidence supports the amount attributed to the defendant.
  • Role in a conspiracy: Whether the evidence establishes an agreement and the defendant’s actual participation rather than mere association with others.

Andrew and Hope Nickel have tried dozens of jury trials and countless bench trials. Their work as former prosecutors helps us anticipate the government’s arguments and prepare a defense grounded in the evidence, governing law, and each client’s circumstances.

What to Do After Federal Agents Contact You

You have the right to consult an attorney before answering questions from DEA agents or other federal investigators. An interview request may sound informal, but your statements can become evidence. Don’t consent to an interview or try to explain the situation before obtaining legal advice.

Early representation also matters after an arrest. The court may schedule a federal detention hearing to decide whether you remain in custody while the case is pending, and deadlines for discovery review and pretrial motions can arrive quickly. Prompt legal representation gives the defense time to preserve issues and prepare for each scheduled proceeding.

Discuss the Investigation or Charge With Our Attorneys

A free consultation gives you an opportunity to discuss what agents have said, whether a warrant or indictment exists, and what may happen next.
